We the undersigned write to oppose the proposed amendment to the Maine Bar Rules because we recognize the indispensable role that systemic advocacy plays in striking at the roots of poverty and improving the lives of people with low income and other vulnerable populations in our state.  We write to share our deep concerns regarding the restrictions proposed on the use of IOLTA funds for Maine civil legal aid organizations that utilize this tool.

Systemic advocacy, which includes class action, legislative, and administrative advocacy, is an indispensable part of civil legal aid that balances the scales of justice and supports our most vulnerable populations in Maine. Although the proposed rule appears to allow use of IOLTA funds for class action litigation, it expressly prohibits use of those funds for legislative advocacy and its limitation on use of IOLTA for "direct legal services to individuals” appears to preclude use of those funds for rulemaking and administrative advocacy.  Such restrictions would negate not only Maine’s longstanding objectives, but also those reflected in the American Bar Association’s Standard for the Provision of Civil Legal Aid.  

Systemic advocacy is often the most cost-effective and impactful means of addressing issues that affect vulnerable populations. In fact, providers can leverage their limited resources to represent hundreds and even thousands of clients at once.  Recent successes include:

• Legal Services for the Elderly advocated to create a surrogacy provision in the law enabling caretaker relatives (a significant number of whom are grandparents) to make medical care and treatment decisions for minors who are living with them and who have no parental support. The need for guardianship or a protective order was avoided.

• Maine Equal Justice (MEJ) advocated on behalf of low-income clients for access to affordable health care through Medicaid expansion first at the legislature, and then as a ballot initiative. MEJ led the litigation to ensure its implementation and has been working with the legislature and state agencies to support its smooth implementation.

• Legal Services for the Elderly successfully advocated in favor of legislation amending the Adult Protective Services Act by defining “financial exploitation” and “undue influence” and adding “financial exploitation” to the definition of “abuse”. This change provides an additional means of protection for adults lacking capacity who have lost or are at risk of losing their financial resources.

• Legal Services for the Elderly and Maine Equal Justice provided legislative advocacy that successfully opposed proposed statutory changes reducing or eliminating access to prescription drugs for elderly or disabled low-income adults.

• Immigrant Legal Advocacy Project helped revise procedure manuals of various state agencies to ensure Maine’s immigrants will not be erroneously denied driver’s licenses or assistance and provides technical and legal expertise on immigration law and policy to the legislature.

• Maine Equal Justice crafted legislation that passed with bipartisan support creating opportunity through education and training for parents so they can increase their earning capacity. The new law will help low-income parents achieve associate degrees or industry-recognized credentials in fields where there is a high demand for skilled workers.

Placing restrictions on systemic legal advocacy at a time when special interest groups wield more and more power will harm low-income Mainers served by these organizations.  Access to justice for all is important not just in the representation of one person at a time in courts of law, but in alleviating poverty and hardship through smart policy reform, cutting through bureaucratic red tape, and in impact litigation where the rights of many are affected at once. The proposed changes to the IOLTA rule would de-fund legal tools needed to achieve these types of successes.

We urge the Court to reconsider the proposed amendments to this rule and allow providers to continue to use IOLTA funds for systemic advocacy.
